Agreement to Terms

By downloading, installing, or using GroceryTap ("the app"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the app.

GroceryTap is developed and maintained by an individual developer based in Missouri, USA ("we", "us", or "our").

Description of Service

GroceryTap is a grocery list management app that helps you:

  • Maintain a list of grocery items you regularly purchase
  • Track quantities and preferences for each item
  • Hand off your grocery list to Instacart for ordering
  • Keep a history of your past orders

GroceryTap is a convenience tool and does not directly sell groceries, process payments, or fulfill orders.

Use of the App

You agree to use GroceryTap only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the app in any way that violates applicable laws or regulations
  • Attempt to reverse engineer, decompile, or disassemble the app
  • Attempt to gain unauthorized access to any systems or networks connected to the app
  • Use the app to transmit any malicious code or harmful content
  • Interfere with or disrupt the operation of the app

Third-Party Services

Instacart

GroceryTap integrates with Instacart to facilitate grocery ordering. When you use this feature:

  • You will be redirected to Instacart's app or website
  • Your use of Instacart is governed by Instacart's Terms of Service
  • We are not responsible for Instacart's services, pricing, availability, or order fulfillment
  • Any issues with Instacart orders should be directed to Instacart support

App Stores

Your download and use of GroceryTap through the Apple App Store or Google Play Store is also subject to the respective store's terms of service.

Your Data

You retain ownership of any data you enter into GroceryTap. Your grocery lists, order history, and preferences are stored locally on your device. See our Privacy Policy for more information about how we handle your data.

You are responsible for maintaining backups of your data. If you uninstall the app or clear its data, your information will be permanently deleted from your device.

Intellectual Property

The app, including its design, features, code, and content, is owned by us and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes.

"GroceryTap" and associated logos are trademarks. You may not use these marks without our prior written permission.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that:

  • The app will be uninterrupted, error-free, or secure
  • Any defects will be corrected
  • The app will meet your specific requirements
  • The integration with Instacart will always function correctly

We do not guarantee the accuracy of product names, categories, or any information displayed in the app.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to:

  • Loss of data or information
  • Loss of profits or revenue
  • Errors in grocery orders placed through third-party services
  • Service interruptions or app unavailability

Our total liability for any claims arising from your use of the app shall not exceed the amount you paid for the app (if any).

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the app or violation of these Terms.

Changes to the App

We reserve the right to modify, suspend, or discontinue the app (or any part of it) at any time without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the app.

Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the app after changes constitutes acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the app shall be resolved in the courts located in Missouri.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
